Terms of Use

Rallyday runs team step leagues for workplaces. Your employer sets up a season, invites you, and places you on a team. Each day, your team's average steps (up to 40,000 per person) are compared with another team's; results are published each morning, and the season ends in playoffs. The full rules are in the app's Season rules.

• You must be 16 or older. If you're 16 or 17, you need a parent's or legal guardian's permission to use Rallyday, and by using it you confirm you have it. You also need an invitation from your employer or from Rallyday.
• One account per person, signed in with your own email address. Keep access to that email secure: anyone who can read it can sign in as you.
• One phone counts your steps at a time. Connecting a new phone replaces the old one.

• Joining is your choice. You can stop at any time by turning off Health access, asking your administrator to pause you, or deleting your account.
• Rallyday isn't a medical, insurance or health-plan program. Whether time spent walking counts as work time is between you and your employer; Rallyday doesn't decide it.
• If a health condition or disability makes it hard to take part the usual way, ask your administrator. Your employer decides any alternative arrangement.

• Rallyday is not medical advice and not a medical device. It counts steps your phone has recorded; it doesn't measure your health, diagnose anything or tell you what's safe for you.
• Check with a doctor before increasing your activity, especially if you have a heart, lung, joint, metabolic or other health condition, are pregnant, or haven't been active for a while.
• Stop and get help if you feel pain, faintness, dizziness, chest discomfort or shortness of breath.
• Walk safely: watch where you're going, not your phone, and follow traffic rules and your workplace's safety rules. Don't walk anywhere you're not allowed to be.
• You decide how much to walk, and you're responsible for doing it safely. To the extent the law allows, Rallyday isn't responsible for injuries from your physical activity.

• Steps come from Apple Health (iPhone) or Health Connect (Android), which combine what your phone and any connected watch recorded. These are estimates; Rallyday counts what Health reports.
• A day counts the steps that reach Rallyday before the next morning's cutoff (9:00 in the season's time zone, unless the Season rules set another time). Steps arriving later don't change that day. A day with no sync is shown as not synced, never as zero.
• Published results are final. Each morning the result is checked before it's published. If a check fails, we may hold that day and work it out again from the same steps, or cancel it. Once a result is published, it isn't changed.
• Team size never decides a game: teams are compared by average steps per person. Only an exact tie on average goes to the team with more total steps.

Count only steps you actually took. Don't:

• put your phone on a device, pet or person to make steps (shakers, swings, mechanical walkers);
• type steps into Apple Health or Health Connect by hand;
• use more than one account, or let anyone else use yours;
• interfere with the app, other people's accounts, the scoring, or our servers.

If something looks wrong, we or your administrator may look into it, and may pause someone from the next day of the league. Results already published stay as they are.

• Rallyday runs the league, including its rules, matchups, and results. The company running your season may offer a prize to the champion team. If it does, the prize and its details are shown in the app and in the Season rules.
• The company provides the prize: it pays for it, hands it out, and decides who on the champion team receives it. Rallyday doesn't provide prizes and isn't responsible for delivering them.
• Taking part is free: there's no purchase or payment to enter or to win.
• The champion is the team that wins the final, as the Season rules describe, once that result is published. Ties are decided by the Season rules. The Season rules in the app are the league's official rules.
• Apple and Google are not sponsors of the league or any prize, and aren't involved in them in any way.

What you share. You choose your display name and, if you like, a photo; your team can choose its name, color and emblem. Everyone in your season sees these, and team names appear in other teams' notifications. You give Rallyday permission to store and show them to the people in your season, only to run the league. You can change your name, and add, change or remove your photo in the app.

What isn't allowed in a name, photo or team name:

• slurs, hate or anything that attacks people for who they are;
• harassment, bullying, threats, or making fun of a person;
• sexual, nude, violent or gory images, or words to the same effect;
• pretending to be someone else, or using another person's photo or name without their OK;
• other people's personal details (addresses, phone numbers);
• advertising, links or spam;
• anything illegal, or that you don't have the right to use.

What happens. Rallyday or your administrator may change, remove or lock a name, photo or team name that breaks these rules, and may pause someone who keeps breaking them. A lock never stops anyone playing: their steps still count. Serious or repeated breaks can end someone's access (§ 9).

Reporting. If you see something that breaks these rules, report it: in the app (Report on the person or team) or by email to support@joinrallyday.com. Reports are confidential: nobody is told who made them, not the person reported and not your administrator. A person, not a machine, looks at every report, and we aim to act within one business day.

Blocking. You can block someone in your season: their photo is hidden from you, and they aren't told. Their name still shows, because it's a league. You can unblock them at any time.

• You can delete your account in the app at any time (see the Privacy Notice for what happens and when).
• Your administrator can move you to another team or pause you, from the next day, and can remove you before the season starts. A pause stops your play until you're resumed.
• We may suspend or end your access if you break these terms, misuse Rallyday, or if your employer's season ends. Where we can, we'll tell you first and say why.

Don't copy, resell or reverse-engineer Rallyday; don't scrape it, overload it, probe it for weaknesses or get around its security; don't use it to break the law or harm anyone. Rallyday's name, logo, app and designs belong to Boop Technologies, LLC.

• Rallyday is new and changing. We may add, change or remove features, and may require you to update the app to keep using it.
• If we change these terms in a way that matters, we'll tell you in the app before the change takes effect. If you don't agree, you can stop using Rallyday and delete your account.

Rallyday is provided "as is". We work to keep it accurate and available, but we don't promise it will always work, that every step will sync in time, or that it's free of errors. To the extent the law allows, we disclaim implied warranties (such as merchantability and fitness for a particular purpose). Some places don't allow these disclaimers, so they may not all apply to you.

To the extent the law allows:

• Rallyday isn't liable for indirect, incidental, special or consequential damages, or for lost data, profits or prizes.
• Our total liability to you for any claim about Rallyday is limited to $100.

Nothing in these terms limits liability that can't be limited by law, such as for fraud, gross negligence, or violations of privacy laws that don't allow it.

• Talk to us first. Email support@joinrallyday.com and we'll try to resolve it within 60 days.
• These terms are governed by Washington law. Any dispute goes to the state or federal courts in King County, Washington, unless the law where you live gives you the right to bring it there. You can use small claims court where it applies.

If you got Rallyday from the App Store, these terms are between you and Rallyday, not Apple; Apple has no obligation to support Rallyday and isn't responsible for it or for claims about it, and Apple's standard license agreement for apps also applies. If you got it from Google Play, Google's terms for Play apply too. Apple and its subsidiaries are third-party beneficiaries of this section.

The website joinrallyday.com describes Rallyday, shows our prices and lets companies contact us. Sending the "Talk to us" form starts a conversation; it isn't a contract and costs nothing. Buying a season online isn't open yet. When it opens, the terms for buying will be shown before anyone pays. Teams, names and scores shown on the site are illustrative examples.

If your employer appointed you to run a season in the Rallyday console:

• You act for your employer, under its agreement with Rallyday.
• Add only people your employer has asked to invite, using their work email addresses, and keep their details accurate.
• Before you send invitations, make sure your employer may invite each person and has told them about the season. Send each person one invitation, and at most a few reminders if they haven't joined.
• Use what the console shows (names, emails, teams, invitation and sync status) only to run the season. Don't use it to monitor or evaluate anyone's work, and don't share it outside the people at your employer who run the program.
• Use the tools for names, photos and reports only to apply the rules in § 8, keep reports confidential, and never tell a person who reported them.
• Keep your sign-in to yourself, and tell us at once if you think someone else has used it.
